Miscellaneous Information
There will be a mandatory Pre-Bid Conference
and Job Walk on May 14, 2021 at 9:00AM
Sharp, at Zela Davis School, 13435 S. Yukon
Ave., Hawthorne, CA 90250. We will gather
at the corner of Yukon Ave. and W. 134th St.
Any Contractor bidding on the Project who fails
to attend the entire mandatory job walk and
conference will be deemed a non-responsive
bidder and will have its bid returned unopened.
Due to the current mandate regarding social
distancing to prevent the spread of COVID-19,
anyone attending the Pre-Bid Conference and
Job Walk shall at all times maintain a distance
of six feet from other people and shall at all
times wear a face covering. And everyone
must complete the health screening on your
mobile device before entering the school
site, the instructions are listed below. If not
compliant, the company representative will
be asked to leave, and the company shall
be deemed non-responsive.System Assessment
Tool – Bidders’ must scan the barcode
or access at COVID Schools | Beach Cities
Health District (bchd.org) before arriving to the
mandatory Pre-Bidder’s Conference and Job
Walk. If a Bidder screens Green, they must
show their Green screen on their mobile device
to district staff and then they will be granted
access to the campus. If a Bidder screens
Red, they will not be granted access to the
campus, no exceptions shall be made, and if
a representative from the company does not
attend the mandatory Pre-Bidder’s Conference
and Job Walk, the company will be deemed
non-responsive.
Each bidder shall be a licensed contractor
pursuant to the California Business and
Professions Code and be licensed to perform
the work called for in the Contract Documents.
The successful bidder must possess a valid
and active B and or C33 License at the time
of bid and throughout the duration of this
Contract. The Contractor’s California State
License number shall be clearly stated on the
bidder’s proposal
Subcontractors shall be licensed pursuant to
California law for the trades necessary to perform
the Work called for in the Contract Documents.
Each bid must strictly conform with and be
responsive to the Contract Documents as
defined in the General Conditions.
In accordance with California Public Contract
Code Section 22300, the Owner will permit
the substitution of securities for any moneys
withheld by the Owner to ensure performance
under the Contract.
Prevailing wages are applicable to the Project.
These per diem rates, including holiday and
overtime work, as well as employer payments
for health and welfare, pension, vacation, and
similar purposes, are available from the Director
of the Department of Industrial Relations.
Pursuant to California Labor Code Sections
1720 et seq., it shall be mandatory upon the
Contractor to whom the Contract is awarded,
and upon any subcontractor under such Contractor,
to pay not less than the said specified
rates to all workers employed by them in the
execution of the Contract.
A contractor or subcontractor shall not be
qualified to bid on, be listed in a bid proposal,
subject to the requirements of Section 4104
of the Public Contract Code, or engage in
the performance of any contract for public
work, as defined in the Labor Code, unless
currently registered and qualified to perform
public work pursuant to Labor Code section
1725.5. It is not a violation of this section for
an unregistered contractor to submit a bid that
is authorized by Section 7029.1 of the Business
and Professions Code or by Section 10164 or
20103.5 of the Public Contract Code, provided
the contractor is registered to perform public
work pursuant to Section 1725.5 at the time
the contract is awarded.
The Contractor and all subcontractors shall
furnish certified payroll records as required
pursuant Labor Code section 1776 directly to
the Labor Commissioner in accordance with
Labor Code section 1771.4 on at least on a
monthly basis (or more frequently if required by
the District or the Labor Commissioner) and in a
format prescribed by the Labor Commissioner.
Monitoring and enforcement of the prevailing
wage laws and related requirements will be
performed by the Labor Commissioner/ Department
of Labor Standards Enforcement (DLSE).
Separate payment and performance bonds,
each in an amount equal to 100% of the
total Contract amount issued by a California
admitted surety as defined in California Code of
Civil Procedure Section 995.120, are required,
and shall be provided to the Owner prior to
execution of the Contract and shall be in the
form set forth in the Contract Documents.
Where applicable (including projects receiving
funding under the State School Facilities
Program), bidders must meet the requirements
set forth in Public Contract Code Section
10115 et seq., Military and Veterans Code
Section 999 et seq. and California Code of
Regulations, Title 2, Section 1896.60 et seq.
regarding Disabled Veteran Business Enterprise
(“DVBE”) Programs.
The Contractor and all subcontractors shall
adhere to all the Federal, State, City, and
Centers for Disease Control (CDC) guidelines
in regards to work and community mitigation
actions to prevent the spread of COVID-19.
Bid Security. Each Bid Proposal shall be
accompanied by Bid Security in an amount
TEN PERCENT (10%) OF THE TOTAL BID
AMOUNT. Failure of any Bid Proposal to be
accompanied by Bid Security in the form and
in the amount required shall render such Bid
Proposal to be non-responsive and rejected
by the District.
No Withdrawal of Bid Proposals. No Bidder
shall withdraw its Bid Proposal for a period of
ninety (90) days after the award of the Contract
by the District’s Board of Education. During this
time, all Bidders shall guarantee prices quoted
in their respective Bid Proposals.
Waiver of Irregularities. The District reserves
the right to reject any or all Bid Proposals or
to waive any irregularities or informalities in any
Bid Proposal or in the Bidding.
Award of the Contract. The Contract for the
Work, if awarded, will be by action of the District’s
Board of Trustees to the responsible Bidder
submitting the lowest responsive Bid Proposal.
Inquiries and Clarifications. The Bidder is
advised that all inquiries and clarifications about
the Bid Documents, Drawings, Specifications,
etc., shall be submitted to the District in writing
at least six (6) calendar days before the
Bid opening date. The District will respond
at its earliest possible opportunity. Verbal
communication by either party with regard to
this matter is invalid. Inquiries shall be sent in

It is each bidder’s sole responsibility to ensure
